Alderney businesses and their employees are reminded that the Conditions of Employment (Alderney) Law comes into force on Tuesday December 7th.
The new law gives Alderney’s workforce the right to a terms of employment statement in plain English.
Based on Guernsey’s Conditions of Employment Law and approved by the States of Alderney in March this year, the new law says employers are expected to provide the basic conditions of a job to an employee in writing.
It is a further step in making the island more attractive to new young professionals as well as for the existing workforce. Business start-ups and those wanting to move to the Island can feel confident that the employment framework is clear for them and all employees.
A Statement of Terms of Employment will provide employees start date, pay rate including overtime rates, shift pay and pecuniary benefits, whether paid weekly or monthly, conditions relating to hours of work, holidays, terms and conditions relating to incapacity including any provision for sick pay, whether a pension or pension scheme is included, terms relating to maternity leave/pay and the employee’s right to return after confinement, and notice period.
Flow charts showing how both employees and employers should approach the written particulars and what to do with resulting statements are now available online under the dropdown labelled ‘Employment Law’. There is also a downloadable Terms of Employment form.
States Member Kevin Gentle, who has championed the new legislation for Alderney, said: “Until now, our employment law has been limited to work permits and employer liability which is not in line with other forward-looking jurisdictions.
“This new law now makes it a legal requirement for employers to provide a simple written statement on the conditions of the employment offered. It’s an important step in the process of enhancing our working relationships and promoting Alderney as a great place to live and work.”
