Lunchtime Lecture: Trusts disputes and arbitration

Settlors, trustees, those administering trusts, and those advising trusts, typically dread disputes arising. Trust disputes can be expensive, time-draining, complicated, and can risk the confidentiality of the trust itself. In an effort to mitigate some of the issues typically associated with traditional dispute resolution methods, there is growing interest globally in the arbitration of trust disputes.
Martha and Steven will explore what arbitration is, the pros and cons of using arbitration to resolve trust disputes, and the current global landscape of arbitration and trust disputes. They will also consider what trustees, trust lawyers, and those developing policy around trusts and the resolution of disputes, should be thinking about when considering whether, and how, to incorporate arbitration into trust structures.
