GFSC Director Registration Regime explained
The Guernsey Financial Services Commission (GFSC) has recently launched a new director registration regime.
All directors should consider whether they are captured by the regime and then register if they are required to do so by 1st October 2023.
The IoD Guernsey branch will host a webinar where Fiona Crocker, Director of the GFSC’s Financial Crime Division, will discuss which categories of directorships will need to register, how to register and how directors are expected to comply with the Proceeds of Crime Law.
The new scheme has been established following amendments to the Criminal Justice (Proceeds of Crime) Law, 1999 and an amendment to the Regulations of Fiduciaries, Administration Businesses and Company Directors, etc (Bailiwick of Guernsey) Law, 2020 Law.
These amendments establish a registration regime for individuals who use the “up to six directorships” exemption from fiduciary licensing where no other exemption from registration applies.
Fiona joined the Commission in May 1999 as an analyst in the Investment Business Division. She was promoted to senior analyst in 2002. In January 2005, she took up the role of Assistant Director in the Fiduciary Division and held the position as a Deputy Director in the Fiduciary Supervision and Policy Division from April 2011 to October 2014. She was appointed Director in November 2014. Fiona graduated from the University of Wales, Cardiff, with a degree in Economics and Social Studies. She is a member of the Chartered Institute for Securities & Investment.
